Former Restaurant Employee Facing Identity Theft Charge

LINCOLNTON, N.C. – Lincoln County Sheriff’s detectives have charged a 46-year-old Stanley man with identity theft.

On January 5, 2018 Travis Lambert reported that he lost his debit card at Midtown Sundries in Denver, N.C. a few weeks earlier and had recently discovered that someone had used the card to make purchases at several businesses in Denver and one business in Gastonia.

Detective Richard Calhoun investigated the case and arrested Brian Pechet Smith, 46, of Blacksnake Road, Stanley, NC. Smith was employed as a server at Midtown Sundries at the time of the incident. Smith was arrested on January 11, 2018 and gave a full confession as to his actions.

Smith stated he found the debit card on the floor at the restaurant. The victim paid in cash, which he pocketed, and Smith used the credit card to pay the bill. He waited a few weeks before using it at the other locations.

Detective Calhoun said, “Ownership and management of Midtown Sundries were extremely involved and cooperative during the investigation and were instrumental in charges being filed. This appears to be an isolated incident involving one rogue employee at the restaurant.”

Smith is charged with one felony count of identity theft fraud and one misdemeanor count of possession of marijuana. He was released after posting a $9,000 secured bond.
