Former Lincolnton attorney John O. Lafferty, Jr. has been charged with Embezzlement in Excess of $100,000, a Class C felony.
Lafferty, who had practiced law in Lincolnton since 1972 was disbarred on April 5th.
According to North Carolina Lawyers Weekly, Lafferty willfully failed to file federal and state income taxes in a timely manner from 2000-2017, failed to pay an undetermined amount of federal and state taxes, and knowingly failed to respond in a timely fashion to the state bar’s investigation inquiries.
He had received a reprimand in May, 2018, when he failed to respond to the state bar’s letters of notice of two grievances filed against him. The investigation into one of those grievances found that Lafferty failed to prepare and file an estate’s 90-day preliminary inventory and failed to reasonably communicate with the client regarding that filing.
In June of this year, the District Attorney's office asked the State Bureau of Investigations (SBI) to look into complaints against Lafferty. A true bill of indictment was returned and he was arrested Wednesday (Sep. 25th) in Carteret County. Lafferty made his quarter million dollar bond and was released pending a first appearance in Lincoln County Superior Court on Monday (Sep. 30th).
